Terms of Service

These Terms of Service ("Terms") govern your access to and use of Fitsana mobile applications, website, and related services (the "Services"). By creating an account or using the Services, you agree to these Terms and our Privacy Policy.

• You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Services.
• If you are under 18, you represent that you have permission from a parent or guardian.
• You must provide accurate account information and keep your login credentials secure.

Fitsana provides digital wellness tools, which may include:

• Personalized and guided workout plans with video coaching
• Sleep sounds, music, stories, and offline downloads
• Nutrition logging, goals, trends, and AI meal photo estimates
• Optional Apple Health sync and progress insights
• Free and premium subscription features

Features may change over time as we improve the product. We may add, modify, or discontinue features with or without notice, except where notice is required by law or platform policies.

Fitsana is a fitness and wellness product for informational and motivational purposes only. It is not a medical device and does not provide medical advice, diagnosis, or treatment.

• Consult a physician before starting a new exercise or nutrition program, especially if you have injuries, medical conditions, or are pregnant.
• Stop exercising if you feel pain, dizziness, or other concerning symptoms, and seek professional care when needed.
• Calorie estimates, AI meal estimates, and similar insights are approximate and may be inaccurate.

You assume all risk associated with activities you undertake based on content in the Services.

You may sign in with email and password, Google, or Apple. You are responsible for activity under your account. Notify us promptly of unauthorized use. We may suspend or terminate accounts that violate these Terms or create risk for other users or the Services.

• Free and premium tiers. Some features require a paid subscription or one-time purchase. Pricing is shown in the app or on our pricing page before you buy.
• Mobile billing. Purchases made on iOS or Android are processed by Apple or Google through RevenueCat. Manage, cancel, or request refunds through the applicable store account settings and policies.
• Web billing. Web subscriptions and purchases may be processed by Polar. Manage billing through the customer portal or support channels provided at checkout.
• Auto-renewal. Subscriptions renew automatically until canceled according to the store or payment provider rules. Cancel before the renewal date to avoid the next charge.
• Credits. Credits (if offered) may be used for eligible AI or premium actions. Credits have no cash value unless required by law and may expire or change as described in-product.
• Changes. We may change prices for future billing periods. Existing subscriptions remain subject to the terms in effect at purchase and platform rules.

You agree not to:

• Copy, redistribute, or publicly perform our workout videos, sleep audio, or other proprietary content except as allowed by the app
• Reverse engineer, scrape, or attempt to access non-public areas of the Services
• Interfere with security, rate limits, or other users' access
• Upload unlawful, harmful, or infringing content
• Misrepresent your identity or create accounts for abusive purposes
• Use the Services for any unlawful purpose

The Services—including branding, UI, workout and sleep catalogs, videos, audio, text, and software—are owned by Fitsana or its licensors and are protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes in accordance with these Terms.

You retain rights to content you submit (such as meal photos or profile information). You grant us a worldwide license to host, process, and display that content solely to operate and improve the Services.

The Services may integrate with third parties such as Apple Health, Google, Apple Sign In, Polar, RevenueCat, and cloud infrastructure providers. Their terms and privacy policies apply to your use of those services. We are not responsible for third-party products or outages outside our reasonable control.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT RESULTS (INCLUDING CALORIE OR NUTRITION ESTIMATES) WILL BE ACCURATE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FITSANA AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $50.

Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent permitted by law.

You agree to defend and indemnify Fitsana and its affiliates from claims arising out of your misuse of the Services, violation of these Terms, or infringement of any third-party right, except to the extent caused by our willful misconduct.

You may stop using the Services and delete your account at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the Services. Provisions that by nature should survive (including ownership, disclaimers, limitations of liability, and indemnity) will survive termination.

We may update these Terms from time to time. We will post the updated Terms on this page and revise the "Last updated" date. Material changes may also be communicated in-app or by email when appropriate. Continued use after the effective date constitutes acceptance.

These Terms are governed by the laws applicable in the jurisdiction where Fitsana operates its primary business, without regard to conflict-of-law rules, except where mandatory consumer protections in your country require otherwise. Platform-specific terms from Apple or Google may also apply to App Store or Play Store purchases.
